Warranty Policy
3-Year Legal Guarantee · TRLGDCU (as amended by RDL 7/2021) · Post-Works Public Liability Insurance
Fecha de entrada en vigor / Effective date: 1 July 2025
This Warranty Policy informs the Client of the warranty rights applicable under Royal Legislative Decree 1/2007 (TRLGDCU), as amended by Royal Decree-Law 7/2021 of 27 April, which transposed EU Directives 2019/770 and 2019/771 into Spanish law with effect from 1 January 2022.
KEY LEGAL NOTE
Since 1 January 2022, the minimum statutory guarantee for new consumer goods in Spain is THREE (3) YEARS from the date of delivery or commissioning. This applies to all products that CasaTech Valencia, S.L. supplies and installs.
1. Statutory Guarantee on Products (3 Years)
All new equipment supplied and installed by CasaTech (routers, WiFi access points, smart locks, speakers, smart home devices, etc.) carries a minimum statutory guarantee of three (3) years from the date of delivery to the Client, under Articles 114–126 TRLGDCU. During the first two (2) years after delivery, any lack of conformity is presumed to have existed at the time of delivery, unless CasaTech can prove otherwise or this presumption is incompatible with the nature of the defect. A lack of conformity entitles the Client to: (1st) repair or replacement of the product, at the Client's choice, free of charge; (2nd) if repair or replacement is impossible or disproportionate, a price reduction or termination of the contract with a full refund.
2. Guarantee on Installation Works
The guarantee on installation works carried out by CasaTech covers defects in execution that prevent the installed system from functioning correctly. The claim period is two (2) years from handover of the installation, under Article 1591 of the Spanish Civil Code and applicable case law on contracts for works. Not covered: natural wear from use, damage caused by misuse, alterations made by the Client or unauthorised third parties, power surges or supply interruptions, or incompatibilities arising from changes in third-party software or services (e.g. changes to manufacturer APIs).
3. Guarantee on Digital Content and Services
Automation scripts, configurations and digital content delivered by CasaTech carry a conformity guarantee of two (2) years from delivery, under Articles 126bis et seq. of the TRLGDCU (transposing Directive 2019/770). Where CasaTech provides software or firmware updates as part of the service, these will be supplied throughout the agreed warranty period.
4. Warranty Exclusions
• Damage caused by the Client, unauthorised third parties or external causes (power surges, moisture, impact, etc.).
• Modifications to the system made without CasaTech's knowledge or consent.
• Consumables (batteries, bulbs, etc.) except for manufacturing defects.
• Normal wear resulting from ordinary use of the product.
• Incompatibilities arising from unilateral changes by third-party platforms (Apple HomeKit, Google Home, Amazon Alexa, etc.).
• Installations carried out in environments that did not meet the technical requirements specified by CasaTech in the quote.
5. How to Make a Warranty Claim
• Contact CasaTech at concierge@casatechvalencia.com describing the problem, providing your invoice or project reference number and, where possible, photos or video of the defect.
• CasaTech will respond within 3 business days to arrange a diagnostic visit or remote resolution.
• Repair or replacement will be carried out within a reasonable time and at no cost to the Client, including travel.
• If the defect is not remedied within a reasonable period, the Client may request a price reduction or termination of contract.
6. Insurance Cover: Post-Works Public Liability
CasaTech Valencia, S.L. holds a Public Liability (Responsabilidad Civil) insurance policy that includes Post-Works (RC Post-Trabajos) cover. This covers third-party damage (to persons or property) caused by installation defects attributable to CasaTech after completion and handover of the installation. What Post-Works cover includes: material or personal damage to third parties resulting from an installation fault attributable to CasaTech (e.g. improperly fixed equipment that falls and damages the Client's property). The cover remains in force throughout the policy period and for 36 months after any policy cancellation. What it does not include: defects in the installed product itself — that falls under the manufacturer's warranty and the statutory guarantee described above. Post-Works liability cover protects third parties from consequential damage; it does not replace the conformity guarantee.
7. Manufacturer's Commercial Guarantee
In addition to the statutory 3-year legal guarantee, the manufacturers of installed equipment (TP-Link, Nuki, Sonos, Shelly, etc.) may offer additional commercial guarantees, which the Client may exercise directly with the manufacturer or through CasaTech. These commercial guarantees do not limit or replace the consumer's statutory rights. CasaTech will provide the Client, together with the project handover documentation, with the serial numbers of all installed equipment, manufacturer warranty registration details and the relevant technical support channels.
8. Availability of Spare Parts
Under Article 127bis of the TRLGDCU, durable goods must have adequate technical service and spare part availability for ten (10) years from the date the product ceases to be manufactured. CasaTech selects manufacturers with an established presence in the European market who meet these requirements.
