Terms & Conditions of Service

These General Terms and Conditions govern the relationship between CasaTech Valencia, S.L. ("CasaTech") and the client ("Client") for the supply of residential technology installation services. Accepting a quote or placing an order for any service constitutes full acceptance of these terms.

2. Description of Services

 

CasaTech provides installation, configuration and commissioning of residential technology systems, including: WiFi mesh networks, smart home and lighting automation, access control, multi-room audio, and other home automation systems. Services are described in detail in the accepted quote.

 

3. Contracting Process

 

The contracting process begins with the Client's request for a quote. CasaTech will issue a detailed quote stating the scope of work, materials to be installed, total price (including VAT) and estimated completion time. The contract is formed when the Client communicates acceptance in writing (including email) or pays the agreed initial deposit. In accordance with Article 98 of the TRLGDCU, consumer clients will receive contract confirmation on a durable medium.

 

4. Prices and Payment

 

All prices in quotes include Spanish VAT (IVA) at the applicable rate. CasaTech reserves the right to apply domestic reverse charge (inversión del sujeto pasivo / ISP) where the Client is a VAT-registered business and legal conditions are met. Standard payment schedule: (i) 50% of the total price on contract formation or before work begins; (ii) remaining 50% on completion and handover of the installation. Accepted payment methods are bank transfer, credit/debit card or as expressly stated in the quote. Late payment will accrue interest at the legal rate plus two percentage points.

 

5. Timescales

 

Estimated completion times stated in the quote are indicative. CasaTech will use its best endeavours to meet them but accepts no liability for delays caused by factors outside its control (material unavailability, structural conditions of the property, third-party actions, force majeure). If timescales change significantly, the Client will be informed as soon as practicable.

 

6. Client Obligations

 

The Client must: (a) provide access to the property at agreed dates and times; (b) ensure adequate electrical infrastructure is in place where required; (c) inform CasaTech of any structural, regulatory or community restrictions that may affect the installation; (d) designate a decision-making contact throughout the works.

 

7. Right of Withdrawal

 

Under Articles 102–108 of the TRLGDCU, consumer clients have the right to withdraw from a distance or off-premises contract within 14 calendar days of the contract date, without reason and without penalty. To exercise this right, notify us by unambiguous communication (e.g. letter or email) before the deadline. The right of withdrawal does not apply where, at the consumer Client's express request, works have begun during the withdrawal period and the Client has consented in writing, in which case CasaTech may retain a proportionate amount for work already carried out (Art. 107.3 TRLGDCU).

 

8. Intellectual Property

 

All documents, designs, network diagrams, configurations and materials delivered to the Client are CasaTech's own work. The Client receives a non-exclusive licence to use them for the purposes of the project. CasaTech retains all intellectual property rights. Software installed on devices is subject to the respective manufacturers' licences.

 

9. Liability

 

CasaTech is liable for damage directly caused by proven negligence in carrying out the works, up to the insured sum under our public liability policy. We are not liable for indirect losses, loss of profit, data loss or consequential damage of any kind. Total liability in any event will not exceed the total contract value, except in cases of fraud or gross negligence.

 

10. Governing Law and Jurisdiction

 

These Terms are governed by Spanish law. Disputes will be referred to the Courts and Tribunals of Valencia, Spain, without prejudice to any mandatory consumer jurisdiction under the TRLGDCU. Consumer clients may also access the EU Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.

 

11. Amendments

 

CasaTech may amend these Terms. Changes will apply to contracts concluded after publication on the website. Contracts already in force will continue to be governed by the Terms in effect at the time they were formed.
